వివరణ (న్యాయ మంత్రిత్వ శాఖతో సంప్రదించి): శిక్ష నిర్ణయంలో గత చెడు రికార్డు లేదా పూర్వ శిక్షలను పరిగణించాలంటే వాటిని ఛార్జిషీట్‌లోనే నిర్దిష్ట ఆరోపణగా చేర్చాలి.
కారణం: ఆరోపణల్లో చేర్చకుండా శిక్ష ఉత్తర్వులో గత రికార్డు ప్రస్తావిస్తే చర్యలు చెల్లవు; పూర్వ శిక్షలపై ఆధారపడుతున్నట్లు షోకాజ్ నోటీసులో తెలియజేయాలని, ఉద్యోగి వివరణ ఇవ్వగలగాలని సుప్రీంకోర్టు పేర్కొంది (ఆర్టికల్ 311(2)).
